Declaration of boating activity exemption

Parks Victoria as the declared waterway manager for the waters of the Yarra River (upstream of port waters of the Port of Melbourne) under the Marine Safety Act 2010 (Vic) makes the following declaration under section 203(3) of the Act.

For the purposes of conducting the Dragon Boats Victoria 2014/15 series of events, as detailed in Table 1, conducted by Dragon Boats Victoria in their application of 14 and 22 October 2014 under section 203(1) of the Act, vessels involved in the event are exempt from the requirements of:

  1. Clause 2(a) of the Notice under Section 15 of the Marine Act 1988 – the requirement to operate a vessel at 5 knots within 50 metres of a person in the water (rescue vessels only when engaged in a rescue);
  2. Clause 2(c) of the Notice under Section 15 of the Marine Act 1988 - the requirement to operate a vessel at 5 knots within 50 metres of another vessel (competitors vessels only when within 50 metres of another competing vessel or rescue vessel); and
  3. Clause 3.1 of Schedule 3 of the Notice under Section 15 of the Marine Act 1988 – the 5 knot speed limit on the Yarra River upstream of port waters of the Port of Melbourne (competitors’ vessels only).

These exemptions apply to vessels involved with the 2014/15 Dragon Boats Victoria series of events for the times and areas listed in Table 1, Table 2 and Table 3, provided the stated safety controls and undertakings detailed in the Event Application and associated documentation are adhered to.
