Declaration of Boating Activity Exemption - 2017 Winter Regatta on Albert Park Lake

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for the waters of Albert Park Lake under the Marine Safety Act 2010 (Vic) (Act) makes the following declaration under section 203(3) of the Act.  For the purpose of conducting the 2017 Winter Regatta on Albert Park Lake by Albert Sailing Club, in their application under section 203(1) of the Act, persons and vessels involved in the regatta are exempt from:

  1. Clause 2(a) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of a person in the water.
  2. Clause 2(c) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of another vessel.
  3. Clause 3(a) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of the waters’ edge.
  4. Clause 3(b) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of a fixed or floating structure.
  5. Clause 151.1 of Schedule 151 of the waterway rules in respect to the 5 knot speed restriction for vessels with engines on the waters of Albert Park Lake.
  6. Clause 151.2 of Schedule 151 of the waterway rules in respect to the prohibition of vessels with engines on the waters of Albert Park Lake.

These exemptions apply as follows:

  • The masters of rescue vessels are exempt from items 1-6 above. The exemptions for items 1-5 only apply when undertaking a rescue operation to retrieve persons in distress and provide for their initial medical or other needs and deliver them to a place of safety.
  • The masters of competing vessels are exempt from items 3-4 above.  Note: an ongoing exemption from clause 2(c) applies to competing vessels under the exemption for Yachting Victoria events conducted under the Racing Rules of Sailing.
  • The master of the committee/start vessel is exempt from item 6 above. The exemptions apply from 10:00 am to 5:30 pm on Saturday 24 June 2017 and 9:00 am to 5:30 pm on Sunday 25 June 2017, provided that the stated safety controls and undertakings detailed in the Event Application and associated documentation are adhered to. By order of Parks Victoria
