Declaration of boating activity exemption - Dragon Boat Victoria events 2017-18

Parks Victoria as the declared waterway manager for the Maribyrnong River upstream of Shepherd Bridge on Footscray Road, the National Water Sports Centre and the Yarra River upstream of port waters of the Port of Melbourne under makes the following declaration under section 203(3) of the Marine Safety Act 2010.

For the purpose of conducting Dragon Boat Victoria events as detailed in Table 1 below from 29 October 2017 to 08 April 2018, competing and rescue vessels are exempt from:

Competitors and rescue vessels during the event only:

  1. Clause 2(c) – 5 knots within 50 metres of another vessel.
  2. Clause 3(a) – 5 knots within the waters’ edge.
  3. Clause 3(b) – 5 knots within 50 metres of a fixed or floating structure.
  4. Clause 3.1 – 5 knot speed restriction on the Yarra River upstream of the port waters of the Port of Melbourne.
  5. Clause 4.1 – 5 knot speed restriction on the Maribyrnong River upstream of Shepherd Bridge.

Rescue vessels when undertaking rescue activities only:

  1. Clause 2(a) – 5 knots within 50 metres of a person in the water.
  2. Clause 2(c) – 5 knots within 50 metres of another vessel.
  3. Clause 3(a) – 5 knots within 50 metres of the waters’ edge.
  4. Clause 3(b) – 5 knots within 50 metres fixed or floating structure.
  5. Clause 3.1 – 5 knot speed restriction on the Yarra River upstream of the port waters of the Port of Melbourne
  6. Clause 4.1 – 5 knot speed restriction on the Maribyrnong River upstream of Shepards Bridge.

EXEMPTION CONDITIONS

  • Competitors are only exempt from items 1-5 when competing in an event.
  • The masters of vessels providing rescue are only exempt from items 6-11 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety.
  • The masters of rescue vessels must not exceed the speed of competing vessels unless undertaking a rescue operation to retrieve persons in distress and provide for their initial medical needs.
  • Occupants of dragon boats and powered vessels including rescue vessels used in conjunction with the event must be wearing a personal floatation device at all times during the event.
  • The exemptions apply for the dates and times detailed in Table 1, to the persons and vessels participating in the Dragon Boat Victoria events provided the undertakings detailed in the event application and associated documentation are adhered to at all times.
