Declaration of boating activity exemption - Kia'Opua Outrigger Canoe Club Winter Series Race

Parks Victoria as the declared waterway manager for Port Phillip Bay, North West, from Wedge Point, Werribee South, to the Yarra River, under section 203(3) of the Marine Safety Act 2010 (the Act) makes the following declaration.

For the purpose of conducting the OC1/OC2/V3 Winter Series Race by the Kia'Opua Outrigger Canoe Club, competing and rescue vessels are exempt from:

Competitor vessels during the event only:

  1. Exemption from 5 knots within 200 meters of the waters’ edge – clause 4(a), and 1.5.7;
  2. Exemption from 5 knots within 50 metres of another vessel – clause 2(c);
  3. Exemption from 5 knots within 50 meters of a fixed or floating structure – clause 3(b); and
  4. Exemption from regulation to carry a bailer or bilge pump on human-powered vessel on enclosed waters – clause 96(5), 96(7).

Rescue vessels when undertaking rescue activities only:

  1. Exemption from 5 knots within 200 meters of the waters’ edge – clause 4(a) and 1.5.7;
  2. Exemption from 5 knots within 50 metres of another vessel – clause 2(c);
  3. Exemption from 5 knots within 50 meters of a fixed or floating structure – clause 3(b); and
  4. Exemption from 5 knots within 50 metres of a person in the water – clause 2(a).

EXEMPTION CONDITIONS

  • The exemption applies from 8.00 am to 5.00 pm on Saturday 23 July 2017 for the waters of the Port Phillip Bay, North West, provided that the stated safety controls and undertakings detailed in the Event Application and associated documentation are adhered to.
  • The masters of competing vessels are exempt from items 1-4 in the above list when competing in the event.
  • The masters of rescue vessels are exempt from items 5-8 only when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore. Any vessels that are designated for the rescue of persons must turn engine off before bringing person on board.
