Declaration of Boating Activity Exemption - Life Saving Victoria Calendar Events

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for waterways as detailed in Table 1 (below) makes the following declaration under section 203(3) of the Marine Safety Act 2010.

For the purpose of conducting the 2017-2018 Life Saving Victoria Calendar Events conducted between the 22 October 2017 to 04 March 2018 at various times detailed in Table 1, competing and rescue vessels are exempt from:

Competitors and rescue vessels during the event only:

1. Exemption from 5 knots within 50 metres of another vessel – clause 2(c);
2. Exemption from 5 knots within 200 meters of the waters’ edge – clause 4(a);
3. Exemption from 5 knots within 50 meters of a person in the water (cl.2a);
4. Exemption from 5 knots speed restriction zones as detailed in Schedule 1 and Schedule 5 of the Vessel Operating and Zoning Rules. Williamstown 1.5.9. (b), Half Moon Bay 1.1.7, South Melbourne 1.1.7 (b), Sandridge 1.1.7 (a), Chelsea 1.2.7, Altona 1.5.9 (a), Mt. Martha 1.2.7, Mordialloc 1.2.9 (b), Point Leo 5.3 a (i);
5. Exemption from the relevant areas prohibited to vessels as detailed in Schedule 1 of the Vessel Operating and Zoning Rules. Rosebud & McCrae 1.3.9 (c) Safety Beach 1.3.9 (a), Williamstown 1.5.9 (b), Half Moon Bay 1.1.9 (i), South Melbourne 1.1.9 (b), Sandridge 1.1.9 (a), Chelsea 1.2.9 (e), Altona 1.5.9 (a) Mt. Martha 1.2.9 (n) Mordialloc 1.2.9 (b), Hampton 1.1.9 (g);
6. Exemption from the requirements of Regulation 96(2) and 100(1) in respect to carrying a PFD for each person on board and wearing a PFD, for competing surfboats only.

Rescue vessels when undertaking rescue activities only:

7. Exemption from 5 knots within 50 metres of a person in the water – clause 2(a);
8. Exemption from 5 knots within 50 metres of another vessel – clause 2(c);
9. Exemption from 5 knots within 200 meters of the waters’ edge – clause 4(a);

Martha 1.2.9 (n) Mordialloc 1.2.9 (b), Hampton 1.1.9 (g).

EXEMPTION CONDITIONS

  • The masters of competing vessels are exempt from items 1, 2, 3, 4, 5, 6 in the above list when competing in the event.
  • The masters of rescue vessels are exempt from items 7, 8, 9, 10, 11 in the above list only when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore. Any vessels that are designated for the rescue of persons, must be fitted with propeller guards, in order to minimise the risk of propeller strike injury to people in the water. Those not designated as rescue boats that are required to assist with rescue in an emergency must turn their engine off before bringing persons on board.
  • Exemption items 1 and 7 above will be automatically suspended for any periods when  swimmers or other vessels not associated with the event approach within 50 meters of any vessel or swimmer involved in the event.
  • Exemption items 1 and 7 above will apply only to operators and vessels associated with the event and are noted on a list maintained by Life Saving Victoria.
  • Surf boats and crew competing in the Life Saving Victoria 2017-2018 calendar of events as detailed in Table 1 are exempt from the requirements of Regulations 96(2) and 100(1) of the Marine Safety Regulations 2012 in respect to carrying a PFD for each person on board and wearing a PFD.
  • Exemptions from the Marine Safety Regulations 2012 for carrying equipment and wearing PFDs have also been applied for.  LSV currently has general on-going exemptions from the requirement to carry safety equipment and the requirement to wear PFDs for formal competition and training and whilst operating within visual range of a staffed lifesaving facility or flagged area for various sized mechanically powered vessels.  Therefore these exemptions already apply for equipment (IRB & PWC operators will wear PFDs).
  • This exemption only applies whilst the prevailing surf conditions at the event location have been assessed as having a Surf Hazard Rating (SHR) of a value no greater than 12.  For conditions assessed as having a SHR of a value of 13 or more, the exemption only applies on the condition that there are 2 IRBs operating to follow the surf boats the entire length of the course, each IRB is equipped with appropriate rescue tubes, Life Saving Victoria monitors the surf boat crew during the events, and Life Saving Victoria report on the Surf Hazard Rating for each event
