Declaration of Boating Activity Exemption - Winter Sculling Series

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria, as the declared waterway manager for the waters of the Yarra River upstream of the port waters of the Port of Melbourne, Albert Park Lake, Maribyrnong River upstream of Shepherd Bridge on the Footscray Road under the Marine Safety Act 2010 (the Act), makes the following declaration under Section 203(3) of the Act.

For the purpose of conducting the Winter Sculling Series by Victorian Sculling Association Inc. (VSA) in their application under section 203(1) of the Act, competing and rescue vessels are exempt from:

All events - competitors and rescue vessels during the event only:
1.Exemption from 5 knots within 50 metres of another vessel – clause 2(c);
2.Exemption from 5 knots within 50 metres of water’s edge – clause 3(a);
3.Exemption from 5 knots within 50 metres of a fixed or floating structure – clause 3(b) (Maribyrnong River and Yarra River);
4.Exemption from 5 knots on the Maribyrnong River upstream of the Shepherd Bridge – clause 4.1;
5.Exemption from 5 knots on the Yarra River upstream of port waters of the Port of Melbourne – clause 3.1.

All events - rescue vessels when undertaking rescue activities only:
6.Exemption from 5 knots within 50 metres of a person in the water – clause 2(a).

EXEMPTION CONDITIONS
*The exemptions only apply for the time, date and location as specified in Table 1, attached.
*The stated safety controls and undertakings detailed in the event application, the Sculling Victoria Safety Management Plan and associated documentation must be adhered to.
*The masters of competing vessels are exempt from items 1 – 5 in the above list when competing in the event. Under current equipment exemption arrangements competing rowers are exempt from the wearing and carrying of PFDs.
*The masters of rescue vessels are exempt from items 1 – 6 in the above list only when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore. Any vessels that are designated recue vessels must be fitted with propeller guards, in order to minimise the risk of propeller strike injury to people in the water. Those not designated as rescue vessels that are required to assist with rescue in an emergency must adhere to the SMP and turn engine off before bringing a person on board.

The 8.6 km Sculler’s Head of the Yarra starts at Hawthorn Rowing Club and finishes at the Judge’s Box.
