Declaration of Boating Activity Exemption

I, Graeme Davis, District Manager Port Phillip Western Port, as delegate of Parks Victoria the waterway manager for the National Water Sports Centre, declare under section 203(3) of the Marine Safety Act 2010 (Vic) that persons and vessel participating in the Southern Waters Ski Show events detailed in Table 1, are exempt as follows:

1. The requirements of the following clauses of the Notice under section 15(2) of the Marine Act 1988:

  • clause 2(a) - 5 knots within 50 metres of a person in the water;
  • clause 2(c) - 5 knots within 50 metres of another vessel;
  • clause 3(a) - 5 knots within 50 metres of the waters edge; provided vessels do not exceed 5 knots within 10 metres of the water's edge;
  • clause 3(b) - 5 knots within 50 metres of a fixed or floating structure; and
  • clause 19(b) - master of a vessel must not tow more than 3 persons

 

2. The requirements of the following Marine Safety Regulations 2012:

  • Regulation 103 - person being towed by a vessel must wear a PFD.
  • Regulation 104(2) - master of a vessel must not tow a person unless the person is wearing a PFD.

These exemptions apply only to waterskiers who are involved in:

- a 3 person high pyramid on the second or third tier,

- Rope held by the toe manoeuvres,

- Swivel acts, and

- Double couple acts.

 

3. The requirements of the following Marine Safety Regulations 2012:

  • Regulation 96(6) – master must ensure their vessel is equipped with appropriate safety equipment (only applies to water-skiers being retrieved who are exempt from wearing a PFD).
  • Regulation 100(3) – person must wear a PFD when on board a vessel 4.8 metres or less in length (only applies to water-skiers being retrieved who are exempt from wearing a PFD)..
  • Regulation 104(1) – Master must ensure all occupants of vessel are wearing a PFD (only applies to water-skiers being retrieved who are exempt from wearing a PFD).

These exemptions apply only to persons on board that Exemption 2 applies to.

 

4. Exemptions from above rules only apply to the vessels listed within event application and during the event training and display times as listed in the event application.

The exemptions apply for the dates and times detailed in Table, to the persons and vessel participating in the Southern Waters Ski Show team events at the National Water Sports Centre, provided the undertakings detailed in the event application and associated documentation are adhered to at all times.
