Declaration of rowing activity exemption - Australian Henley Regatta, 24 February

PUBLIC NOTICE

DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for Yarra River upstream of the port waters of the Port of Melbourne makes the following declaration under section 203(3) of the Marine Safety Act 2010.

For the purpose of conducting the Australian Henley Regatta on the Yarra River on 24 February 2018 between 6.00 AM to 5.00 PM, masters of vessels involved in the regatta are exempt from the waterway rules as follows :

Masters of competitor's vessels during the event only:

  1. Exemption from 5 knots within 50 metres of another vessel- clause 2(c);
  2. Exemption from 5 knots within 50 metres of the waters' edge- clause 3(a);
  3. Exemption from berthing at boathouses from downstream Schedule 3 - clause 3.4(a)

Masters of rescue vessels when undertaking rescue activities only:

4. Exemption from 5 knots within 50 metres of a person in the water- clause 2(a) ;
5. Exemption from 5 knots within 50 metres of another vessel- clause 2(c);
6. Exemption from 5 knots within 50 metres of the waters ' edge- clause 3(a);
7. Exemption from berthing at boathouses from downstream Schedule 3- clause 3.4(a)

EXEMPTION CONDITIONS

The above exemptions only apply within the exclusion zone for the waters of the Yarra River between a straight line from the downstream edge of Swan Street floating Landing (Melbourne Park) to the Henley Landing at Kings Domain and the upstream edge of Church St Bridge, provided that the stated safety control and undertakings detailed in the event application and associated documents are adhered to.

The masters of competing vessels are exempt from items 1 - 3 in the above list when competing in the event. The event will be conducted in accordance with the Rowing Victoria Safety Management Plan. Under current equipment exemption arrangements competing rowe rs are already exempt from the wearing and carrying of PFDs.

The masters of rescue vessels are exempt from items 4 - 6 in the above list only when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore. Any vessels that are designated for the rescue of persons must have propeller guards fitted or must turn engine off before bringing person on board. Item 7 may be undertaken by official powered vessels during race associated duties only.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

Parks Victoria as the declared waterway manager for the Yarra River upstream of the port waters of the Port of Melbourne hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that the waters of the Yarra River between a straight line from the downstream edge of Swan Street floating Landing (Melbourne Park) to the Henley Landing at Kings Domain and the upstream edge of Church St Bridge are prohibited to all persons and vessels not registered to take part in Australian Henley Regatta . The exclusion zone takes effect between 6.00 AM to 5.00 PM on 24 February 2018.
