Declaration of boating activity exemption - Victorian Drag Boat Club

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for the Patterson River, upstream of the Nepean Highway Bridge to Eumemmering Creek (including the National Water Sports Centre) makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).

For the purposes of boating activity conducted by the Victorian Drag Boat Club Inc., persons and vessels involved in the Liquid Quarter Mile Series, as detailed in Table 1 below, are exempt from the following requirements:

State Rules made under the Marine Act 1988

  1. Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water – applies to rescue vessels;
  2. Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel – applies to competing vessels and rescue vessels;
  3. Clause 3(a) – must not exceed 5 knots within 50 metres of the waters’ edge – applies to competing vessels and rescue vessels;
  4. Clause 3(b) – must not exceed 5 knots within 50 metres of a fixed or floating structure – applies to competing vessels and rescue vessels;

Marine Safety Regulations 2012

  1. Regulation 96(5) – requirement to carry a bucket with lanyard, a waterproof buoyant torch and a fire extinguisher and paddle – applies to competing vessels;
  2. Regulation 96(6) – requirement for master to carry a personal flotation device (of type specified) for all persons – applies to competitors operating enclosed cockpit and capsule vessels only;
  3. Regulation 100(3) – requirement for a personal flotation device (of type specified) to be worn at all times by a person in an open area of a vessel underway – applies to competitors operating enclosed cockpit and capsule vessels only.

Subject to the conditions detailed below:

  • Masters of rescue vessels are only exempt from items 1 to 4 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore.
  • Masters of competing vessels are only exempt from items 2 to 5 for the duration of the events.
  • Masters of competing vessels are only exempt from items 6 and 7 provided they are operating an enclosed cockpit or capsule vessel and wear a personal flotation device which conforms with Victorian Drag Boat Club Rules and comply with Victorian Drag Boat Club race rules and procedures.
  • All participants on vessels involved with the event must wear a personal flotation device at all times during the event.
  • These exemptions are active for the times and dates detailed in Table 1 below, to persons and vessels registered to participate in the Victorian Drag Boat Club Liquid Quarter Mile Series, provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.
