Declaration of boating activity exemption - Volvo Ocean Race

Parks Victoria as the declared waterway manager for the Yarra River upstream of port waters of the Port of Melbourne and the Local Port of Port Phillip under the Marine Safety Act 2010 (Vic) makes the following declaration under section 203(3) of the Act.

For the purposes of facilitating the entry and departure of Volvo Ocean Race Yachts to and from Victoria Harbour from 12.01 am Sunday 24 December 2017 until 5:00pm Tuesday 2 January 2018, participating vessels and support vessels associated with the race are exempt from:

  1. The requirements of clause 3.3(c) (i) of Schedule 3 of the Notice under the Marine Act 1988, prohibiting the mooring and or berthing on the waters of the Yarra River upstream of port waters of the Port of Melbourne to Dights Falls.

Competing vessels involved in the Volvo Ocean Race, when racing are exempt from:

  1. The requirement to not exceed 5 knots when within 50 metres of another competing vessel as detailed clause 2 (c) of the State Waterway Rules of the Notice under the Marine Act 1988 between from 12.01 am Sunday 24 December 2017 until 6:00pm Tuesday 2 January 2018.

EXEMPTION CONDITIONS

  • These exemptions only apply between the stated dates and times above, and only to persons and vessels registered to take part in the Volvo Ocean Race – provided that the risk controls and undertakings detailed in Event Application and associated documentation are adhered to.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

In accordance with section 208(2) of the Marine Safety Act 2010 (Vic), Parks Victoria, the waterway manager for the Yarra River upstream of the port waters of the Port of Melbourne and waterway manager for the Local Ports of Port Phillip and Western Port, gives notice that:

1)            All persons and vessels not registered to take part in the Volvo Ocean Race 2017-18 are prohibited from entering or remaining on the waters of the Yarra River in an area bounded by buoys in the locations detailed in Table 1.

The exclusion zone takes effect between 12:01am on Sunday 24 December 2017 to 5:00pm on Tuesday 2 January 2018 when competing or support vessels involved in the Volvo Ocean Race are required to moor or berth within the area (as per associated declaration of boating activity exemption) provided the risk controls and undertakings detailed in the Event Application and associated documentation are adhered to.

2)            All persons and vessels not registered to take part in the Volvo Ocean Race are prohibited from entering or remaining on the waters in Mornington adjacent to Mornington Pier in an area within a 300m radius of the Turning Buoy. The Turning Buoy will be positioned by the Volvo Ocean Race at 38° 12.506'S, 145° 1.601'E

The exclusion zone takes effect between 2:00pm to 6:00pm on Tuesday 2 January provided the risk controls and undertakings detailed in the Event Application and associated documentation are adhered to.
