Declaration of Safety Exemptions – Dragon Boat Victoria – Buddha’s Day & Multicultural Demonstration Paddle

DECLARATION OF BOATING ACTIVITY EXEMPTION

I, Edena Critch, District Manager Waterways, as delegate of Parks Victoria the waterway manager for the Yarra River upstream of port waters of the Port of Melbourne, declare under section 203(3) of the Marine Safety Act 2010 (Vic) that persons and vessels participating in the Dragon Boat Victoria demonstration as part of Buddha's Day Festival 2018, are exempt as follows:

1.         Clause 2(c) of the waterway rules - the requirement not to operate a vessel exceeding 5 knots within 50 metres of another vessel.

2.         Clause 3 of the waterway rules - the requirement not to operate a vessel exceeding 5 knots within 50 metres of the waters’ edge and a fixed or floating structure.

3.         Schedule 3, clause 3.1 of the waterway rules - 5 knot speed restriction on the Yarra River upstream of the port waters of the Port of Melbourne

EXEMPTION CONDITIONS

The masters of vessels providing rescue services must not exceed the speed of a competing dragon boat vessel unless otherwise undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety and includes any on-water activities that may be preliminary or incidental to that operation.

All occupants of vessels involved in the event (dragon boats and rescue) must wear an approved PFD at all times, including when transiting to and from the event.

The exemptions apply on Sunday 20 May 2018 from 11.00am to 11.45am within the event exclusion zone (the waters of the Yarra River from the downstream edge of the VRA landing to the upstream edge of Federation Wharf, and extending 300 metres upstream), provided that the stated safety controls and undertakings detailed in the Event Application and associated documentation are adhered to.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

Parks Victoria, the declared waterway manager for the waters of the Yarra River upstream of the port waters of the Port of Melbourne, gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not registered to take part in the Buddha's Day & Multicultural Demonstration Paddle, are prohibited from entering and remaining in the waters of the Yarra River between a diagonal line from the downstream edge of the VRA landing to the upstream edge of Federation Wharf, and extending 300 metres upstream.

The exclusion zone takes effect between 11:00am to 11:45am on Sunday 20 May 2018.
