Declaration of Safety Exemptions – Carrum Masters Regatta – National Water Sports Centre

DECLARATION OF BOATING ACTIVITY EXEMPTION
Parks Victoria as the declared waterway manager for the Patterson River, upstream of Nepean Highway Bridge to Eumemmering Creek, makes the following declaration under section 203(3) of the Marine Safety Act 2010.
For the purpose of conducting the Carrum Masters Regatta at the National Water Sports Centre on 21 April 2018 between 8:00 am to 4:00 pm, the masters of participating vessels are exempt from:
- Clause 2(c) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of another vessel; and
- Clause 3(a) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of the waters’ edge, providing vessels do not exceed 5 knots within 10 metres of the water's edge.
This event is operating under the auspices of Rowing Victoria, including the Rowing Victoria Safety Management Plan, which meets the criteria of Clause 3 of Exemption Notice 1 of the Notice made under the Marine Regulations 1999 in respect of the exemption for rowing vessels to not carry or wear a personal flotation device.
- The masters of powered vessels must ensure they comply with the Marine Safety Act 2010 and gazetted waterway rules in respect to minimum speed and distances requirements, unless otherwise undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety.
- The exemptions apply provided the stated safety controls and undertakings detailed in the Event Application and Safety Management Plan are adhered to.
