Declaration of Safety Exemptions – Victorian Sculling Association – Winter Sculling 2018

PUBLIC NOTICE

DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for the Yarra River upstream of port waters of the Port of Melbourne, the Maribyrnong River upstream of Shepherd Bridge and Albert Park Lake, makes the following declaration under section 203(3) of the Marine Safety Act 2010.

For the purpose of conducting the 2018 Winter Sculling Series by the Victorian Sculling Association Inc., competitors and masters of participating vessels are exempt from:

  1. Clause 2(c) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of another vessel;
  2. Clause 3(a) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of the waters’ edge;
  3. Clause 3(b) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of fixed or floating infrastructure, (Maribyrnong River and Yarra River only);
  4. Clause 3.1 of Schedule 3 of the Notice under the Marine Act 1988 in respect to the 5 knot speed restriction on the waters of the Yarra River upstream of port waters of the Port of Melbourne;
  5. Clause 4.1 of Schedule 4 of the Notice under the Marine Act 1988 in respect to the 5 knot speed restriction on the waters of the Maribyrnong River upstream of the Shepherd Bridge;

Masters and occupants of competitor vessels only:

  1. Regulation 96(6) of the Marine Safety Regulations 2012, in respect to the requirements to carry a PFD for each person onboard;
  2. Regulation 100(3) of the Marine Safety Regulations 2012, in respect to the requirements to wear a PFD; and

Masters of rescue vessels only when undertaking a rescue:

  1. Clause 2(a) of the Notice under the Marine Act 1988 in respect to operating a vessel at a speed not exceeding 5 knots within 50 metres of a person in the water; and
  2. Clause 151.1 of Schedule 151 of the Notice under the Marine Act 1988, in respect to the 5 knot speed restriction on powered vessels on the waters of Albert Park Lake.

EXEMPTION CONDITIONS

  • The exemptions apply only from 8:00 am to 11:30 am on the dates and locations specified in Table 1 attached.
  • The stated safety controls and undertakings detailed in the event application, the Sculling Victoria Safety Management Plan and associated documentation must be adhered to.
  • The masters of rescue vessels are exempt from items 1 to 5 and 8 to 9 in the above list only if undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety. Any vessels that are designated rescue vessels must be fitted with propeller guards, in order to minimise the risk of propeller strike injury to people in the water. Those not designated as rescue vessels that are required to assist with rescue in an emergency must adhere to the SMP and turn their engine off before bringing a person on board.

Certain Victorian Sculling Association Inc. powered vessels have been approved by Parks Victoria to operate on the waters of Albert Park Lake as per Clause 151.2(a) of Schedule 151 of the Notice under the Marine Act 1988.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

Parks Victoria, as the declared waterway manager for the Yarra River upstream of port waters of the Port of Melbourne, hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not participating in Victorian Sculling Association - Winter Sculling 2018 events are prohibited from entering and remaining on the waters for the dates and locations as detailed below from 8:00 am to 11:30 pm:

  • Saturday 16 June 2018 all waters of the Yarra River between a diagonal line from the downstream edge of the VRA Landing to the upstream edge of Federation Wharf and Herring Island;
  • Saturday 18 August 2018 all the waters of the Yarra River between a diagonal line from the downstream edge of the VRA Landing to the upstream edge of Federation Wharf and the upstream edge of Church Street Bridge.
