These terms and conditions apply to all members' access, use of, and contribution to, Parks Victoria's website. By registering, you agree to be bound by these terms and conditions. These may change from time to time and you should visit our website regularly to check for updates. If you break the rules in any way, your membership will be suspended immediately and without explanation.
2. Member rights and responsibilities
2.1 Member Use
Parks Victoria's website is a service provided by Parks Victoria to enable registered members of this website to contribute comments to Parks Victoria, upload images and discuss comments made by others. Parks Victoria's website must only be used by members for personal and non-commercial purposes.
2.2 Membership registration to be accurate
To contribute to this website, you must have a registered user name and password. You must provide Parks Victoria with your real name and a valid email address. Please don't impersonate other people! Parks Victoria may publish your real name under any contributions you make on Parks Victoria's website but we will not make your email address publicly available.
2.3 No multiple logins or user names
Only one user name must be created per participant. You should not use multiple user names or logins. Use of multiple logins may result in the suspension or cancellation of your membership without notice.
2.4 User names and passwords
Members are responsible for ensuring that their user name and password is only known to them and is not shared with anyone else. You can change and reset your username and passwords. Please let us know if you need a hand doing this.
2.5 No Spam or email harvesting
We won't tolerate any members who in any way try to, or help others to, harvest email addresses for any purpose whatsoever. Our email addresses are for legitimate contact only. Put simply, if you try to spam us, we will notify the proper authorities. Your membership will be immediately cancelled (without notice) if this occurs.
2.6 No reproduction of written text
Except where necessary for viewing the material on the website on your browser, no written text or material on this website is to be reproduced, adapted, uploaded, framed, performed in public, distributed or transmitted to any third party in any form, or by any process, without our express written agreement. If you really want to reproduce it, contact us first to discuss it.
2.7 Reproduction and licensing of media
Members who upload photos to Parks Victoria's website must agree to a creative commons licence. Your file will be uploaded to and served by Parks Victoria under the Creative Commons Attribution-ShareAlike 3.0 Licence. Videos will be uploaded to and served from YouTube under the Creative Commons - Attribution license. Details of creative commons licensing can be found at http://wiki.creativecommons.org.
Please note that creative commons licensing is strictly subject to the operation of any governing laws (including fair dealing, as defined and permitted under Australian Copyright law) and in the event of inconsistency, these laws will prevail over the operation of these terms and conditions. Parks Victoria will not accept any liability arising from any media uploaded by a member. You will separately licence Parks Victoria to use your artwork under condition [3.3] below.
3. Member warranties to Parks Victoria
3.1 Intellectual property
Material which infringes on another person's copyright must not be added. It's in the interest of all members to keep the Parks Victoria website infringement free. Upon contributing text or images to Parks Victoria's website, you warrant to Parks Victoria that the text and images are your own original work that they are not defamatory and do not infringe on any law in the state of Victoria, Australia.
3.2 No illegal access
Upon registration, you warrant to Parks Victoria that you will not attempt to gain illegal access to any part of the Parks Victoria website. This includes member information and email addresses.
3.3 Licences to Parks Victoria
By contributing text or images to Parks Victoria's website, you grant Parks Victoria a perpetual, non-exclusive and irrevocable licence to use, reproduce, modify, adapt and publish any of your contributions for any of Parks Victoria's projects, media and promotions.
If you do not want your contribution to be used in this way, you should not make contributions to Parks Victoria's website.
3.4 Members accountable for contributions
Parks Victoria is not responsible for any actions, claims, proceedings or liabilities arising from your failure to adhere to our terms and conditions. You are responsible for all statements made by you, and for acts that occur through the use of your username and password. By using our website, you agree to indemnify us, our employees and agents, against all claims, demands, damages, costs, penalties and liabilities caused by your breach of these terms and conditions or your use of our website.
4. Discussion rules
Contributions or edits to contributions published on Parks Victoria's website should be factual, descriptive and must relate to the topic.
Your comments and submissions are welcome. You are encouraged to join the open conversation and debate among your fellow Parks Victoria website members. All we ask is that you participate in a lawful manner and that you ensure that contributions you post do not include content which is:-
offensive, derogatory or attacking of another member, Parks Victoria or Parks Victoria's staff;
racist, sexist, homophobic, sexually explicit, abusive or contain swear words;
statements in breach of a law, or which encourage unlawful activity, in particular a breach of copyright, threatening or intimidating statements, or an act which may amount to defamation;
descriptions or encouragement of activities which could endanger the safety or well-being of others;
content, viruses or programs that are harmful or could cause damage to a computer, software program, network or server;
personal information about yourself or another member or person;
spam, copies of existing contributions, commercial advertising or promotion;
links to other websites which do not contribute or are not relevant to the park management; and
false or mischievous complaints or statements about individuals, companies or the government.
4.2 Contributions to declare associations and affiliations
In the interests of fair game, Parks Victoria requires you to be open and honest about your affiliations or associations when making contributions. Where appropriate, you must jot these down at the end of your contributions.
4.3 Contributions must be in English
So that Parks Victoria can monitor the website, all contributions must be submitted in English.
4.4 Contributions to the wiki may be altered
Upon making contributions to an area of the website which operates as a wiki, you accept that other members may edit or alter you contribution in accordance with these terms and conditions.
Parks Victoria will moderate the contents of Parks Victoria's website in accordance with the terms on this page. You can notify Parks Victoria of any content that you consider offensive or a breach of these terms and conditions by using the "Report this content" link. For further help, please contact us.
If you are the owner of any text or images which you believe have been used without your permission, please contact us so that we can arrange for the content to be removed.
4.6 Disciplinary action
If you don't follow our rules, Parks Victoria may at any time (and without prior notice) delete any contributions or terminate your membership. Members may also be suspended for a period of time at any time and at our discretion.
5.1 No warranty
We can't and we don't warrant the completeness or accuracy of any of the content found on our website, or its usefulness for any particular purpose. Nor do we represent or warrant that the content on the website complies with the laws of any country. If you access the website from outside Australia, you do so at your own risk. While we try to keep the website open and functioning day and night, we can't promise that the website will be delivered to you uninterrupted, timely, secure, or error-free.
Parks Victoria does not endorse or promote any opinion or representation published on Parks Victoria's website. Parks Victoria will not accept any responsibility arising from any reliance placed by a person or entity on any comment or information published on Parks Victoria's website.
We're human too and sometimes we get it wrong. Parks Victoria will post retractions and apologies at its discretion i.e. when we're asked nicely and when we think they are necessary. If there is something that gets your goat, please contact us and we will look into it for you.
5.3 Limitation on liability
Parks Victoria will endeavour to hold, retain and protect data submitted on Parks Victoria's website however members should keep of a copy of their own contributions.
5.3 Governing laws
Parks Victoria's website is subject to the laws and regulations in the State of Victoria, Australia. In the event of inconsistency, these laws will prevail over the operation of these terms and conditions.
5.4 Parks Victoria Public Organisation
Members should be aware that Parks Victoria is a public organisation and as such is subject to the Freedom of Information Act 1982 (FOI Act), Information Privacy Act 2000 (Privacy Act) and Public Records Act 1973 (Public Records Act). Member contributions to Parks Victoria's wePlan Blog and Wiki may be subject to the provisions of these Acts. For example, once published contributions may be deemed public records or in the event of an application, may be required to be disclosed under the FOI Act. If you do not want your contributions to be subject to these Acts, you should not make contributions to Parks Victoria's website.
6.1 Collection of Personal Information
6.1.1 Personal information only used for purpose of collection
Parks Victoria's website does not collect or use personal information except that information which you have provided to us freely upon registration, through online forms or surveys or as part of a service request. Personal Information will only be used for the purpose for which you have provided the information and to the types of third parties which we identify to you.
6.1.2 Collection and disclosure of IP addresses
Please note that all members who use Parks Victoria's website will automatically have their IP addresses logged. We will not disclose your IP address except in the case of a breach of these terms and conditions, unlawful activity, or where we are compelled to do so by law, in which case, your IP address may be disclosed without notice being given to you.
Your contributions will automatically be published and your user name and/or real name may be associated with your contribution.
Personal information you have provided to us will not be disclosed to third parties, except where we are authorised, or required, by law to do so.
6.3 Protection of personal information
Once personal information comes into our possession, we will take reasonable steps to protect that information from misuse, loss, authorised access, modification and disclosure. Please visit our privacy page for details.
6.4 No warranty
There are risks associated with transmitting information over the internet. While we strive to protect the information provided to us over the internet, we cannot warrant the security of any information transmitted to us online. If you're not comfortable with this, you should not become a member.
